Lourdes M. Turrecha is an associate attorney in Arent Fox’s San Francisco office. Her practice is focused on privacy, data security, advertising, and intellectual property. Lourdes is experienced in helping organizations develop their privacy and data security programs and is knowledgeable in international (e.g. GDPR, EU-US Privacy Shield), federal (e.g. HIPAA, GLBA, COPPA), state, and local privacy laws; industry standards (e.g. PCI DSS); and privacy and security frameworks (e.g. NIST, GAPP, ISO, FedRamp). She is also experienced in reviewing promotional materials and registering trademarks.

Previous Work

Prior to joining Arent Fox, Lourdes was a consultant on law and policy for a company that develops software training for organizations to use in spreading awareness on protecting privacy, minimizing data security breaches, and dealing with online social media issues. She was also the Senior Policy Manager of Privacy for an international gaming, hospitality, and entertainment company, where she helped build their privacy program from the ground up. During law school, she clerked for the General Counsel of a multinational corporation, where she handled a wide range of day-to-day legal issues that covered privacy, trademarks, and promotions, amongst others. She was also a privacy research associate for one of the leading privacy law scholars.

Regulation from Across the Pond: GDPR’s Implications for United States Health Care Organizations

What’s New?

In May 2018 - merely 14 months from now - the European Union’s (EU) General Data Protection Regulation (GDPR) will go into effect. Organizations established in the European Economic Area (EEA) are subject to the GDPR and must abide by its rules with respect to the collection, processing, and transfer of personal data. And as we explained last year, health care and other organizations not established in the EEA that collect or process European personal data (by offering goods or services to individuals in the EEA or monitoring their behavior) are also subject to the GDPR - a controversial extraterritorial reach.

At PrivacyCon, Researchers Discuss Today’s New Technologies, Highlight Not-So-New Privacy and Security Issues

What’s New?

On January 12, 2017, the Federal Trade Commission (FTC) held its second PrivacyCon conference. PrivacyCon brings together researchers, academics, industry representatives, consumer advocates, and government regulators, to discuss the latest research and trends related to consumer privacy and data security. This year’s PrivacyCon featured presentations from academics and technology researchers covering the following five main areas: (1) the Internet of Things (IoT) and Big Data; (2) mobile privacy; (3) consumer privacy expectations; (4) online behavioral advertising; and (5) information security. FTC Chairwoman Edith Ramirez, who is stepping down effective February 10, 2017, opened the conference with the myriad of ways consumer data is collected, asking if the risks associated with data collection outweigh the benefits.

Life’s a Breach - Sitting on that HIPAA Breach Notification Could Burn You

What’s the News?

On January 9, 2017, Presence Health agreed to settle with the U.S. Department of Health and Human Services (HHS) potential violations under the Breach Notification Rule of the Health Insurance Portability and Accountability Act of 1996 (HIPAA). This is HHS’ first enforcement action against a covered entity that reported a breach, but did not do so timely.
